If both of the following conditions are met, EU manufacturers or importers of articles must notify ECHA within six months after a substance is added to the Substances of Very High Concern (SVHC) Candidate List:
The SVHC concentration in the article exceeds 0.1% (w/w);
The total quantity of the SVHC manufactured or imported into the EU in the article exceeds 1 ton per year per manufacturer or importer.
If any SVHC in the Candidate List exceeds a concentration of 0.1% (w/w) in a substance/mixture-type product, a Safety Data Sheet (SDS) must be provided to the buyer.
If an article contains a substance listed on the Substances of Very High Concern (SVHC) Candidate List with a concentration exceeding 0.1% (w/w), the obligation to provide sufficient information to recipients/consumers must be fulfilled. This includes enabling safe use, at minimum by disclosing the substance’s name, and the relevant information must be provided free of charge within 45 days.
Since January 5, 2021, articles placed on the EU market containing SVHCs exceeding 0.1% must submit a SCIP notification. The notification must identify the minimal article(s) containing SVHC exceeding 0.1% within complex articles and specify their location within the complex article.
